2. Acceptable Use

You may only use our services lawfully. Prohibited uses include:

Misrepresenting AI as human where disclosure is required
Promoting illegal or restricted products

Violations may result in suspension or termination of access.

3. AI & Automated Systems

AI-powered systems may occasionally misunderstand requests, provide incorrect responses, or route communications incorrectly.
Systems are provided “as is”; we do not guarantee outcomes, business results, or 100% accuracy.
AI systems are not a substitute for emergency services.

4. SMS & Messaging Compliance

By opting into SMS communications:

You consent to receive service notifications, appointment reminders, AI-driven messages, and marketing messages (explicit opt-in only).
Consent is not required for purchase; message frequency may vary. Message/data rates may apply.
Reply STOP to opt-out; reply HELP for assistance.

We do not sell, rent, or share mobile numbers for third-party marketing.

5. User Responsibilities

Users must:

Provide accurate, lawful, and up-to-date information
Comply with all applicable laws and regulations
Obtain proper consent before uploading customer data
Use AI and messaging systems responsibly and legally

You are solely responsible for the content, compliance, and legality of communications sent on your behalf.

6. Intellectual Property

All proprietary software, AI systems, workflows, prompts, strategies, and materials remain the exclusive property of Afconia Analytics. Clients receive a limited, non-transferable license to use deliverables for internal business purposes only.

7. Liability & Indemnification

To the fullest extent permitted by law, Afconia Analytics is not liable for lost profits, business interruption, data loss, or indirect/consequential damages.
Total liability is limited to the amount paid in the 30 days preceding a claim.
Users agree to indemnify and hold harmless Afconia Analytics from claims arising from misuse of services, non-compliant communications, or violations of law.

8. Carrier Disclaimer

Mobile carriers are not responsible for delayed, misdirected, or failed messages. We are not liable for delivery issues caused by carrier systems or network limitations.

9. Privacy & Data Handling

We implement industry-standard safeguards, including encryption, access controls, and monitoring.
We only collect data necessary to operate and improve our services.

10. Third-Party Services

11. Termination & Provider Discretion

We reserve the right to suspend or discontinue services to any user at any time, without prior notice or liability.
Signed client agreements govern specific billing, IP, and service terms.

12. Force Majeure

We are not liable for interruptions or failures caused by events beyond our reasonable control, including natural disasters, network outages, third-party failures, or other unforeseen events.

13. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Afconia Analytics operates, without regard to conflict-of-law principles.
